That the results of our 2003 survey test would be both anonymous and confidential. The information unfortunately regarding those tests was taken by the government. In reads that they conducted several years ago. Union as you know went to court. We contended those raids were unconstitutional. And three different federal district courts agreed that the government had violated the Fourth Amendment. Appeals were files and again as most of you know that litigation. Is now pending before the ninth Circuit Court of Appeals. They are our orders in place. That render confidential that seal any information. With respect to the 2003 results several courts have put those orders in place. Some lawyers. Unfortunately appear to have violated. Those court orders. Most recently in New York Times reported. I want to make sure I get this right. That David Ortiz and mean your -- is quote are among the roughly 100 major league baseball players to test positive. For performance enhancing drugs in 2003. Those of the words that appeared. In the times and again according to the times. Their source. Where their sources I should say we're quote lawyers with knowledge of the test results. Who quote spoke anonymously. Because the testing information. Is under seal by court order."
" In response. To the times' story which is not the first story. On this subject on the union fell. It was necessary and appropriate for us to issue a statement regarding. 2003 testing that was issued this morning. The commissioner's office I understand has also issued a statement. Regarding 2003 testing. I intends. To respect. The orders entered by the courts. And as a result of that. There's a limit to what I can say and I would imagine if you have any questions from -- media limit terms of how I can answer. But I want to do a couple of things that I am permitted to -- into the court order first. I want to make clear to everyone. In nature of the conversations they union lawyers had with players both in 2004 on this subject. -- more recently. When I'm about to say. Has been. Written in detail in a letter that Donde you're saying. To congressman Waxman and Davis. It also was described to senator Mitchell before he issued his report. In 2004. Union lawyers myself and others. Told players they were on a government list. We said that list was attached to a grand jury subpoenas that the government has issued. And the government issued that subpoena after they had -- Our lab and the testing company. We specifically told the players. We don't know how the government compiled that list. We don't know why you're name is on that list. We don't know whether you tested positive or negative in 2003. We did saying. That based on the numbers. It's impossible it every person on that list of 104. Could've been positive. The numbers just didn't work. The numbers as many of you know they're a hundred foreign names on the list. What we know. By we the commissioner's office in the players' association. What that there were 83 confirmed. Positive results. For 2003. That was the number that triggered. The 5% threshold. I should -- cross the 5% threshold and triggered. Additional testing. I want to emphasize that 83 is a number of test results. It's not necessarily the number of individual players. Because under 2003. Survey testing. Some players were tested more than once. So it's entirely possible. That in 83 positive test results were from fewer than 83 different players. Another number you've seen a number that I believe was in the commissioner's office. Press release today is 96. 96 is the outer limit. Of test results that could've been positive. In 2003. There were thirteen results. That in the union's -- were inconclusive. And it's. Normally if those results would have had. Individual consequences. For the players involved. We would have pursued. I had to get it definitive answer to whether or not those results were reliable that wasn't necessary here because of the fact that -- 83 was sufficient. To trigger a program testing and we didn't need to go further. So that's what we told players. Began. We told no players in 2004 that they had tested positive. And when David and I spoke. Shortly on the updated the times report issued I could not tell him then that he tested positive. I am precluded by court orders from commenting to any player or commenting publicly. About anything that I might know. At this stage about the 2003 results. I want to emphasize. Finally a couple of things that are in our press release. Most importantly again it is unfair. In my view I fear in the extreme. To -- any connection. Between. Whether player's name is on the list. And whether either pay the player tested positive. Would be the player cook anything that was either banned or illegal. Normally the union would not even confirm or deny whether the players on the list. I confirm that because David publicly address that publicly acknowledged it otherwise I wouldn't. Even be doing that. Once the players is acknowledged to be on the list. There are several reasons why it would be unfair to draw any conclusions. Beyond the fact he's on the list the first as our press release indicates or the numbers I won't run through them again. The second is as I said there is substantial number of those results. That. We disputed by the union were inconclusive. The parties never got to the bottom of whether or not they would hold up. As positive. And third. As has been reported as well. As you will call during 2003. Interest -- I -- was not banned by our program. And more importantly or as importantly. It was a perfectly legal supplement to purchase. Because of that our testing program had to. Account for the possibility. That a player might appear to have tested positive for a banned steroids when in fact he took interest -- began. A perfectly legal and available supplement. And because of that we had -- testing. To ensure that we did not have. Positive that result of interest seeing them. The last one I want to make as all of you assess what David had to say this goes not just for David but for any player who has been. Identified as possibly being on the list or any player who might be identified as possibly being on the list. Understand the position those players are in. They're being accused of doing something wrong. They don't know the specifics of what they're being accused of and they don't have access to any of the information. That might help them to defend against those charges. David Ortiz. Along with all of the members of the union that I am privilege to represent. Work hard. To be role models work hard. To gain their respective fans. And before anyone jumps to a conclusion. That any of these individuals. Because they're name is reported to be I'll list. I don't know if that's accurate or not I just know the universe of possible people."
